By accessing and using our website you are deemed to confirm that you have read, understood and agreed to be bound by these Website Terms. If you do not agree to any part of the Website Terms, you must not access, or must immediately stop accessing, our website.

Neither our website, nor any material on it, may be downloaded, altered, modified, reproduced, transmitted or distributed without our consent. In this Privacy Policy, us, we, or our means Jade Software Corporation Limited and each of its subsidiaries, Jade Software Corporation (NZ) Ltd, Jade Software Corporation Pty Ltd and Jade Software Corporation (UK) Ltd (together Jade Software).

This Privacy Policy outlines how we implement practices, procedures, and systems that ensure compliance with the New Zealand Privacy Act 2020 (the Privacy Act), the Privacy Act 1988 (Cth) (the Australian Act), the Data Protection Act 2018 (the UK Act), and General Data Protection Regulation (GDPR) in relation to our collection, use, holding, and disclosure of personal information.

We collect personal information when you use our mobile applications, websites, and other online products and services (collectively, the “Services”). 

We encourage you to read this Privacy Policy carefully so that you understand our personal information handling practices. By accessing our Services, or otherwise providing us with personal information, you authorise us to collect, use and disclose personal information in accordance with this Privacy Policy.

This Privacy Policy will be reviewed from time to time to take account of new or amended laws, new technology and/or changes to our operations and practices, and the changing business environment. All personal information held by us will be governed by the most recently updated Privacy Policy.  We may also take additional steps to bring the changes to your attention, including by notifying you directly. 1. Scope and purpose 

 This Privacy Policy applies to personal information we may collect and process such as:  

  • Full name
  • Contact information (work or home postal address; work, mobile or home telephone number; work or personal email address)
  • Employer or agency, industry, and job title
  • Delivery and payment information
  • Survey response data
  • Education and experience information (CV information; professional experience; employment history; education; certifications; personal interests)
  • Engagement information (order, engagement and collaboration history; contractual relationship information; inquiries, feedback and comments; content contained in email exchanges with us)
  • Internet Protocol (IP) address
  • Location data
  • Cookie data (including third-party cookies and related data)
  • Information available from Social Media use

We do not use, share, or disclose personal information collected or received through our websites except as described in this Privacy Policy. 

You have certain rights in relation to your personal information, which may include those rights described below in section 8. We will always fully respect your rights regarding the processing of your personal information.

 

2. How we obtain your  personal information and why we have it

We collect personal information you provide directly to us, such as when you create or modify your account; become a subscriber;  submit a contact form through our website; complete a survey or questionnaire; request services from us; provide us with your business card at a trade show; contact our customer support or sales teams by phone, online, or through chat; or otherwise communicate with us. This information may include those types described in section 1 above or any other information you choose to provide. 

We also receive personal information indirectly such as when generated by your activity on our websites and online services (e.g., the amount of time spent on a particular page of our websites); when shared with us by our business partners (e.g., email marketing vendors, trade show sponsors, HR staffing agencies) or when available through publicly available sources (e.g., information shared by you on LinkedIn).

Our primary purposes for collecting information about you include (as applicable):

  • Providing, maintaining and/or improving our products and/or services; including sending invoices, developing new features, providing customer support, sending product and platform updates, and administrative messages.
  • Providing you with details of our products or services; this may include contacting you for a demonstration of a product, to discuss a service offering to your company, and to provide you with news and information about our services that may be of interest to you.
  • Performing internal operations; including prevention of the abuse of our services, to troubleshoot software bugs and operational problems, report statistics, analyse trends, and diagnose problems.

You can generally use our websites without disclosing any personal information. However, if you choose not to disclose any personal information, we may not be able to provide certain Services to you. If we do collect personal information, we’ll ask you first (for example, via a contact form).

We don’t collect personal information without your knowledge. 

If you provide personal or other information about someone other than yourself at any time, you must have that person’s consent to provide such information for the purpose for which you provide it to us. 

Our lawful basis for collecting, using, sharing and keeping your personal information include:

(a) Your consent. You may withdraw your consent at any time, see section 8 for further details.

(b) We have a contractual obligation.

(c) We have a legal obligation.

(d) We have a legitimate interest.

 

3. Holding of information 

Unless otherwise indicated, any personal information will be held by Jade Software. It may be stored or accessed on our behalf by authorised third parties, if necessary. We will keep your personal information secure in accordance with the Privacy Act, the Australian Act, the UK Act, and GDPR. Any authorised third parties will be subject to our information security and privacy requirements. 

We implement and maintain reasonable restrictions on the retention of personal information and generally dispose of such personal information once it is no longer necessary for the purposes for which it was collected or further processed. 

However, we may continue to store archived copies of your personal data for legitimate interests; or where such information is held on IT back-up systems and cannot practically be retrieved, returned or destroyed; or as necessary to comply with applicable laws.

 

4. Use of personal information 

There are many reasons why we may need personal information. We will generally only use personal information provided to us through our websites for the purpose you provided it.  We may use your personal information for another purpose where you have consented to us doing so.

We will never sell or rent personal information collected to third parties for marketing purposes. 

We may use your personal information for a secondary ancillary purpose or where required or permitted by applicable laws. 

 

5. Disclosure of information 

We will generally not share your personal information that is provided or collected, except for the purpose for which you gave us the information (for example, to investigate a complaint) or where you consent.  

Your personal information may be seen by our site administrators, staff and authorised third parties (as appropriate).

We may disclose personal information to third parties:

  • Engaged to perform functions or provide products and services on our behalf, some of these functions include customer relationship management, and email marketing/management (HubSpot, Dynamics), and other services such as mail-outs, debt collection, marketing, research, and advertising. 
  • To provide you with products, services, or content on a joint or 'co-branded' basis.  To access or use co-branded products, services or content, you may have to provide certain requested information which may be shared with our co-branded partners.  You should read the individual privacy policies of our co-branded partners, as these may differ from our privacy policy.
  • As part of any investigation, in relation to you or your activity, that we suspect to be a breach of any of our terms and conditions, serious misconduct, or unlawful (including disclosure to the police, any relevant authority, or enforcement body), or as required or permitted by any law or regulation (including the Privacy Act and other applicable privacy laws).   Some of these third parties to which we may disclose your personal information may be located outside New Zealand. 

Where we transfer your personal information outside New Zealand, we will ensure that we comply with the Privacy Act.

 

6. Opting in and out 

At the point we collect personal information from you, you may be asked to “opt in” to consent to us using or disclosing your personal information for purposes other than those that are expressly stated in this Privacy Policy.  For example, you may be asked to opt in to receive further information or communications from our advertisers or supporters. 

You will be given the opportunity to “opt out” from receiving communications from us or from third parties that send communications to you in accordance with the Privacy Act and other applicable privacy laws. For example, you will be given the option to unsubscribe to emails or newsletters sent by us. 

 You may also opt out of Google Analytics and customize your Google Display Network ads by using the Ads Settings. You can also access Google Analytics’ currently available opt-outs for the web.   

 

7. Security   

Our websites have security measures in place to prevent the loss, misuse, and alteration of information we control. In order to maintain security, our systems (including this website) are subject to ongoing monitoring (including activity logging), analysis, and auditing. We may use information about your use of our websites and other IT systems to prevent unauthorised access or attacks on these systems or to resolve such events, even if you are not involved in such activity. We may use services from third-party suppliers to monitor or maintain the security of systems and information.

If you suspect any misuse, interference or loss, unauthorised access, modification, or disclosure in respect of your personal information, or any other privacy breach, please let us know immediately.

 

8. Your rights

Under the Privacy Act you have the right to: 

  • Find out from us whether we hold personal information about you 
  • Request corrections of your personal information

You may also have rights under the GDPR to erasure of personal information or restriction of processing of personal information or to object to processing, as well as the right to data portability and the right to lodge a compliant with a supervisory authority.

9. Group and campaign emails 

Whenever we send group or campaign emails, we always give you the option to unsubscribe (check the email footer for a link.) 

The messages you get from us cover technology topics and trends in your industry. You’ll only receive them from time to time, rather than on any regular schedule. We don’t send you anything unless we have something to say. We do everything we can to be relevant to you and your job.  We normally use HubSpot for email campaigns. 

You can ask us to remove your email address from our lists by contacting webmaster@jadeworld.com. 

When we link to third-party websites, we are not responsible for the content or privacy policies of those sites. They might have different rules for the use of your personal information.
